Customary Fishing 

Customary fisheries are recognised fishing rights of tangata whenua (people of the land with authority in a particular place) for: 

  • Traditional and customary practices – for example, traditional management of a fishery 

  • Customary non-commercial food gathering. 

Customary fishing takes place in a rohe moana (a defined customary fishing area) of the tangata whenua­.  

Rights guaranteed through legislation 

Customary fishing rights are guaranteed to tangata whenua under Te Tiriti o Waitangi – the Treaty of Waitangi. These rights are protected by law in the: 

  • Treaty of Waitangi (Fisheries Claims) Settlement Act 1992 

  • 1992 Deed of Settlement.

Under the Deed of Settlement, the Crown has specific obligations to Ngati Toa Rangatira  to provide for: 

  • Customary fisheries management practices 

  • Traditional gathering of kaimoana. 

Customary fishing regulations 

Ngati Toa Rangatira falls under two different Customary Fishing Regulations as our Rohe spans both  Te Ika a Maui (North Island) and Te Waipounamu (South Island).  These Regulations are as follows: 

  • The Fisheries (Kaimoana Customary Fishing) Regulations 1998 apply to Ngati Toa Rangatira Rohe in Te Ika a Maui (North Island). 

  • The South Island Customary Fishing Regulations 1999 (pending) will apply to Ngati Toa Rangatira Rohe across Te Tau Ihu o te Waka a Maui (Top of the South Island).

Ngā kaitiaki

Customary Fisheries Tangata kaitiaki/tiaki for Ngati Toa Rangatira are under the umbrella and supported by Te Rununga o Toa Rangatira as the Mandated Iwi Organisation (MIO) and Settlement holder for the Iwi. Tangata kaitiaki/tiaki authorise and manage customary activities, enabling customary fishing and management traditions to continue in the Ngati Toa Rangatira rohe moana. Under the regulations, guardians can be appointed for a specific rohe moana on behalf of Ngati Toa Rangatira. Tangata whenua notify the Minister for Oceans and Fisheries of proposed guardians (called tangata kaitiaki or tangata tiaki). The Minister then confirms their appointment. 

Commercial Fisheries Interests 

Te Rununga a Toa Rangatira have a substantial interest in Commercial fishing quota. Although not involved in the catching of Commercial Fish species, Te Rununga o Toa Rangatira are heavily invested in the trading/leasing of Annual Catch Entitlement (ACE) or Quota Shares which are renewed annually under the Quota Management System (QMS) 

The Quota Management System (QMS) guides the sustainable use of Aotearoa/New Zealand fisheries.

Ika Toa Limited

Ika Toa Limited is a subsidiary company whose primary business is that of Fishing Quota Management and the sale of Annual Catch Entitlement (ACE) owned or leased, on behalf of Te Rununga o Toa Rangatira Inc. 

Ika Toa Limited received fishing quota shares and cash assets mto be held in Trust, in accordance with the Maori Fisheries Act 2004, which were allocated in 2010. 

Ika Toa Limited, as an Asset Holding Company (AHC) for Ngati Toa Rangatira fisheries assets, received coastline derived settlement quota shares under section 135 of the Maori Fisheries Act 2004 in October and December 2014.

Ika Toa Limited currently trades twice a year as Fishing Quota Shares are released under the Quota Management System (QMS).  These shares are released and put out for Tender or lease in April or October of any given year.
